Legal forms are available in many different categories and sub categories, perhaps one of the most common is the Power of Attorney. This is a document that allows you to assign a person or organization to manage your duties and affairs while you are unable or incapable of doing so. Under this legal form, the person or group that you have appointed to handle your duties is considered an ‘Agent’ or ‘Attorney in Fact’. Within this legal form, there are varying types of powers you can assign. For instance there is Special Power of Attorney, Durable Power of Attorney, General Power of Attorney, Health Care Power of Attorney, and of course the Revocation of Power of Attorney. These legal forms each serve a different purpose.
The Special Power of Attorney gives your Attorney in Fact the power to act on your behalf for specific instances and situations only, while the General Power of Attorney gives your Attorney in Fact the power to act on your behalf for various instances and situations. The General Power of Attorney is broadly extensive in the powers it gives, such as: settling claims, buying and selling property, exercising stock rights, handling banking transactions, etc.. Since the Special Power appoints specific tasks, it can include some if not all of these. The Health Care Power of Attorney bestows you the right to appoint someone to make decisions regarding health care for you should you become incapacitated. This can include unconsciousness, your inability to make decisions, or mentally incompetence This is where the Durable Power of Attorney can also come into play, this gives you the power to make the health care, general, and special powers “durable” with some added text, meaning they would stay in effect if you became mentally incompetent. This leaves us with the last legal form as a power of attorney which is the Revocation of Power of Attorney, which of course gives you the right to recall a power of attorney document that was previously created. This particular legal form is used widely across the country for various reasons as can be seen, it is seen as a strong document that can hold a lot of potential for important decisions when people are unable to do so. It is a legal form that not only binds a contract, but also helps people go on about their business without any impedances during their unavailable times.
