Legal forms are available in many different categories and sub categories, perhaps one of the most common is the Power of Attorney. This is a document that allows you to assign a person or organization to manage your duties and affairs while you are unable or incapable of doing so. Under this legal form, the person or group that you have appointed to handle your duties is considered an ‘Agent’ or ‘Attorney in Fact’. Within this legal form, there are varying types of powers you can assign. For instance there is Special Power of Attorney, Durable Power of Attorney, General Power of Attorney, Health Care Power of Attorney, and of course the Revocation of Power of Attorney. These legal forms each serve a different purpose.

The Special Power of Attorney gives your Attorney in Fact the power to act on your behalf for specific instances and situations only, while the General Power of Attorney gives your Attorney in Fact the power to act on your behalf for various instances and situations. The General Power of Attorney is broadly extensive in the powers it gives, such as: settling claims, buying and selling property, exercising stock rights, handling banking transactions, etc.. Since the Special Power appoints specific tasks, it can include some if not all of these. The Health Care Power of Attorney bestows you the right to appoint someone to make decisions regarding health care for you should you become incapacitated. This can include unconsciousness, your inability to make decisions, or mentally incompetence This is where the Durable Power of Attorney can also come into play, this gives you the power to make the health care, general, and special powers “durable” with some added text, meaning they would stay in effect if you became mentally incompetent. This leaves us with the last legal form as a power of attorney which is the Revocation of Power of Attorney, which of course gives you the right to recall a power of attorney document that was previously created. This particular legal form is used widely across the country for various reasons as can be seen, it is seen as a strong document that can hold a lot of potential for important decisions when people are unable to do so. It is a legal form that not only binds a contract, but also helps people go on about their business without any impedances during their unavailable times.

Divorce in New York State

New York state offers a smooth ride for those seeking divorce in the state that don’t have children together. In other states, perhaps a ton of legal form filing is required, or a bunch of additional steps that make the situation even worse. This legal form is known as the “No-Fault Divorce” or “Uncontested Divorce” form. This makes the transition from a married couple to a divorce couple a hassle free environment, with the only time spent waiting is for the forms to be registered and the court to approve them. Under this legal form, the separated couple simply has to fill out their information for the split along with their place of residences at the current time. If the two have lived apart for 1 year or anytime leading up to a year apart, it makes it easier for the court to grant such a divorce. The fact that there are no children involved also speeds up the process, and makes this legal form less trouble to fill out. In this form the defendant and plaintiff will also include the information of their original marriage as well as a short explanation as the reason for the split and divorce. The legal form will also be witnessed and signed by a Notary Public, and dated. A great number of courts in New York request that this legal form be filed in conjunction with a Marital Settlement Agreement. This is yet another legal form that the two must fill out, that has proven to be minor in detail. Its purpose is to formalize an appropriation of the property and finances of the parties in question. On this legal form, the two will state where they will reside post divorce and the titles to what property and belongings will be split. Also included will be expenses, personal property, bank accounts, and debts. The legal form also gives the former wife the option to drop her married name on the bottom of the form, to make it less trouble later on. These 2 legal forms make it a lot easier to file for divorce when a couple has had no children involved and can make a smooth transition for both parties in the state of New York. Other states have different rules, regulations, and requirements and perhaps even more legal forms to fill out when seeking divorce in the same situation. New Yorkers should consider themselves lucky to have an easier process for themselves if they have found themselves under these circumstances.
